1. Acceptance of Terms

By accessing or using the services at buzz-hub.ai (the “Site”) and any associated software, APIs, integrations or workflows (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Services.

2. Changes to Terms

We may modify these Terms at any time by posting the revised version on the Site. Your continued use after changes are posted constitutes acceptance. Material changes will be highlighted via Site notice.

3. Description of Services

BuzzHub provides business automation, HighLevel CRM hosting, and AI-powered phone and messaging solutions. All functionality, data collection, storage, processing and workflows are under BuzzHub’s sole control.

4. Account Registration & Security

• Eligibility. You must be at least 18 and have authority to bind any organization you represent.
• Credentials. You are responsible for safeguarding your login information and all activity under your account. Promptly notify BuzzHub of any unauthorized use.

5. Data Ownership & Control

• Ownership. All data, content, workflows, configurations and system customizations you create or provide (“Customer Data”) are and remain the exclusive property of BuzzHub.
• License to You. BuzzHub grants you a limited, non-exclusive, revocable license to access and use Customer Data solely to utilize the Services as permitted under these Terms.
• Data Deletion. Upon termination of your account, BuzzHub will delete all Customer Data from its systems within 30 days.

6. User Conduct

You agree not to:

• Use the Services for unlawful, infringing, defamatory or fraudulent activities.
• Interfere with or disrupt the integrity or performance of the Services.
• Attempt to gain unauthorized access to any part of the Services, BuzzHub systems or networks.

7. Communications & Marketing Compliance

If you use the Services to send SMS, email, social-media posts or video content that promotes products or services (including HighLevel or other affiliates), you must:

• Obtain express written consent before any text or call outreach (TCPA).
• Include clear opt-out instructions in every message (“Reply STOP to unsubscribe” or unsubscribe link).
• Place a conspicuous disclosure of your material connection to HighLevel or any affiliate at or near the start of all content.
• Comply with all applicable laws and regulations, including TCPA, CAN-SPAM, FTC Endorsement Guides, and HighLevel’s Affiliate Program Terms.

8. Third-Party Integrations & AI Providers

BuzzHub’s Services integrate with HighLevel CRM and third-party AI vendors. BuzzHub is not responsible for those vendors’ performance, security or privacy practices. In any conflict between those policies and these Terms, these Terms prevail as to BuzzHub’s Services.

9. Fees, Billing & Refunds

• Plan Selection. Subscriptions may be on a monthly or annual basis.
• Payment. Charges recur automatically on each billing anniversary until cancellation.
• Sales Final. All fees are non-refundable.
• Collection. BuzzHub collects the full subscription fee directly. Affiliate commissions do not alter your price or obligations.

10. Affiliate Participation & Disclosure

BuzzHub participates in third-party affiliate programs (including the HighLevel Affiliate Program) and may earn commissions when you purchase products or services through links on the Site or via the Services. These commissions do not impact the price you pay. Any affiliate marketing messages you send through the Services must comply with Section 7 above.

11. Intellectual Property

All software, designs, text, graphics and logos (“IP”) are owned or licensed by BuzzHub. You may not copy, reproduce or create derivative works without BuzzHub’s prior written consent.

12. Disclaimers

THE SERVICES ARE PROVIDED “AS IS,” WITHOUT WARRANTIES OF ANY KIND. BUZZHUB DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

13. Limitation of Liability

BuzzHub’s total liability for any claim related to the Services will not exceed the fees you paid in the 12 months preceding the event giving rise to the claim. In no event will BuzzHub be liable for indirect, incidental, special, punitive or consequential damages, including lost profits or data, even if advised of the possibility of such damages.

14. Indemnification

You agree to indemnify and hold BuzzHub, its officers, employees and agents harmless from any claim, loss or damage arising out of your use of the Services, your breach of these Terms or your violation of any law or third-party right.

15. Termination

BuzzHub may suspend or terminate your access at any time for breach of these Terms or for any other reason, with or without notice. Upon termination, your license ends and your data will be deleted as set forth in Section 5.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of New Jersey, without regard to conflict-of-law principles. Any dispute will be resolved by binding arbitration under the American Arbitration Association’s Consumer Arbitration Rules in Monmouth County, NJ. You and BuzzHub waive the right to a jury trial and to participate in class or representative actions.

17. Force Majeure

Neither party is liable for delays or failures due to events beyond reasonable control, including natural disasters, acts of war, terrorism, labor disputes or internet outages.

18. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

19. Waiver

No failure or delay by BuzzHub in exercising any right under these Terms will operate as a waiver of that right.

20. Entire Agreement

These Terms, together with BuzzHub’s Privacy Policy, constitute the entire agreement regarding your use of the Services and supersede all prior understandings.
